Acting as a professional deputy – where someone has lost capacity

As a property and financial affairs deputy, you must have the skills, knowledge and commitment to carry out the effective management of the financial affairs of the person who lacks capacity. You will also have to assure the Court of Protection that there is nothing that makes your appointment inappropriate.

Being appointed as a deputy or attorney is a position of great responsibility and comes with a wide range of legal obligations. It can be difficult to know what you are required to do, and you can be held accountable for making any wrong decisions.

Sintons’ specialist Court of Protection team have the knowledge and experience to support individuals with the day to day management of their property and financial affairs. Our experienced professional deputies work together with family and professionals, including case managers, therapists and financial advisors, to ensure that all decisions made are in the best interests of the individual concerned and adopt the least restrictive approach where possible to empower that individual, to lead as independent a life as possible.

The professional property and financial affairs deputy are the Sintons Trust Corporation Limited. The Trust Corporation is made up of four directors and the benefit of the Trust Corporation, over a specific named individual is:

  • There will never be a need to change your deputy should a member of the Trust Corporation leave Sintons
  • Should a member of the Trust Corporation not be available for any given reason, one of the other three partners will be. We feel this is one of the main benefits as should you need something from your deputy urgently, there will always be someone available to assist.

Our experience allows us to provide expert support whilst ensuring our approach is tailored to each individual and we focus on what is important to each client.
