Myth: Legal Expenses Insurance will cover any claim for personal injury compensation.

Truth: Most legal expenses policies only provide funding for compensation claims when the injury arises from a one off event or accident. The policy very rarely provides cover for claims arising from an industrial disease or other work related conditions which develop over time such as upper limb disorders.

Truth: The accident must have occurred during the period of cover and must usually be reported to the insurers within a set time limit.

Myth: legal expenses insurance will cover all my legal costs

Truth: legal expenses insurance may provide funding for personal injury compensation claims but only up to a pre-determined amount. This in known as the limit of indemnity. You may need to top up your cover with After the Event Insurance if the limit of indemnity is not sufficient.

Myth: I will never pay a penny towards the cost of my personal injury claim if I have legal expenses insurance.

Truth: Most policies do not require any form of contribution although an excess may apply. You need to check the wording of the policy carefully.

Myth: Legal Expenses cover will not be available unless I use the insurance company’s nominated solicitor.
