Pleural Plaques Today

It is no longer possible to recover personal injury compensation from the development of asbestos related pleural plaques in England and Wales. This follows a decision in the House of Lords in October 2007. This decision overturned previous case law which had enabled sufferers of asbestos related pleural plaques to recover compensation for the initial injury and the anxiety that arose as a consequence.

As pleural plaques do not cause any disability and there is no proven link to suggest that anyone who has been diagnosed with pleural plaques will go on to develop a more sinister asbestos related illness, it is not an illness that attracts compensation in England and Wales. It is however still possible to pursue claims for personal injury compensation for pleural plaque injuries where exposure occurred in Scotland or Northern Ireland.

What should I do if I am diagnosed with Pleural Plaques?

Whilst it may not be possible to recover personal injury compensation for your pleural plaque diagnosis in England and Wales, it is an indicator of past asbestos exposure and you should seek medical advice if you suffer any deterioration with your breathing, such as shortness of breath, chest tightness or a persistent cough.
