What is No Win No Fee?

This is when a personal injury claim is pursued under a Conditional Fee Agreement (CFA). We agree that if we fail to recover any compensation we will not look to you for any costs arising from the claim. We will also ensure that you have adequate insurance cover to meet any costs that the other side may be entitled to recover if they win. You will not have to pay the insurance premium in these circumstances. We take all the risk.

What do I pay if I win?

Should you recover personal injury compensation, we will look to you for a success fee. This sum reflects the fact that not all of our costs will be met by the other side and because we have taken all the risk in your claim. This will never be more than 25% of your compensation and in many cases it will be substantially less. At present, for mesothelioma claims only we can recover all costs from the other side so we will not deduct anything from your damages.

How do I pay for other expenses such as Medical Experts and Court Fees?

In nearly every case, we will pay these on your behalf as the claim progresses. We will look to recover the sums paid from the other side if the claim is successful. No charge will be made for this service. We will also obtain insurance on your behalf to cover these costs should the claim lose. This means you will pay nothing if your personal injury claim does not succeed.

Do I always need a No Win No fee agreement?

No, if you are a member of a trade union or you have legal expenses insurance you may not need to enter in to a Conditional Fee Agreement. This is because they may be able to provide full funding for your personal injury claim. We will advise fully at the beginning of the claim to ensure that you only enter in to the funding agreement that is best for you.
