Diffuse Mesothelioma Payment Scheme 2014

The payment scheme has been set up to compensate mesothelioma sufferers who have been negligently exposed to asbestos but who cannot pursue a claim against their former employers because the company has ceased trading and their insurer(s) cannot be identified.

The scheme is only open to people diagnosed with mesothelioma on or after 25th July 2012. It operates on a payment tariff system which is calculated based on the age of the sufferer at the time of diagnosis. If the application is not made during the sufferer’s lifetime the payment tariff is calculated on the age of sufferer when they died.

In general the amount of the payment received under the scheme is less than the amount you would be entitled to receive in a civil claim for compensation in England and Wales.

However, it is a fund of last resort in cases for those who have been negligently exposed to asbestos dust at work and have no chance of receiving any compensation because their old employers and their insurer cannot be found.

Time Limits

You must make an application within 12 months of diagnosis or 12 months of death if you are an eligible dependant.

Forced Blood Transfusion and the High Court's Inherent Jurisdiction. 
In Cumbria, Northumberland, Tyne and Wear NHS Foundation Trust & Anor v QF [2026] the High Court considered whether a hospital could lawfully administer a life-saving blood transfusion under s.63 MHA to a patient who was objecting? The court examined the interface between MHA and the MCA and concluded that in cases where compulsory treatment under the MHA raises exceptional issues and no effective means of challenge exists, the inherent jurisdiction can function as a safeguard.
