Special Expenses


To be eligible for special expenses the applicant must have been incapacitated for a period of more than 28 weeks.

Payments will only be made if they are necessarily incurred as a direct result of the criminal injury for which provision is not available free of charge from another source and the cost is reasonable.

Special expenses will be paid for the following:

  • the applicant’s physical aids lost or damaged in the incident;
  • costs arising from treatment for the injury under the NHS;
  • special equipment;
  • adaptation of the applicant’s accommodation;
  • cost of care in connection with the applicant’s bodily functions or meal preparation;
  • cost of supervising the applicant to avoid substantial danger to themselves or someone else;
  • fees payable to the Court of Protection or Public Guardian under the Mental Capacity Act 2005;
  • costs of the administration of the applicant’s affairs due to their lack of mental capacity;
  • the cost of setting up a trust following a claims officer’s direction.
