Asbestos in Farming Compensation Claims
Over the years and certainly prior to 2000, many farm buildings and structures across the UK were built, extended or repaired using asbestos containing materials (ACMs) such as:
- Cement roof sheets;
- Rainwater guttering and down pipes;
- Cladding;
- Partition walls; &
- Insulation board.
Unfortunately many of these materials remain in place today creating an ongoing risk of asbestos exposure to farmers and labourers, through the general wear and tear of farm buildings and ongoing maintenance and repair works, including demolition of old farm buildings.
Farmers and land tenants are now required under the Control of Asbestos Regulations 2012 to assess the presence and condition of all remaining ACMs to ensure they are well sealed and not damaged. If there are ACMs in poor repair, they have a duty to have them assessed, removed and disposed of by licensed contractors.
