Accidents in Hotels Compensation Claims
Should you be unfortunate enough to suffer injury whilst staying in a Hotel outside of the UK, it may still be possible to pursue a claim for compensation in England or Wales. This will depend upon the manner in which the Hotel booking was made.
Should you be staying in a Hotel as part of a package holiday, the tour operator will be held responsible for any injury which arises as a result of the condition of the Hotel or the negligence of its staff. This would extend to all facilities offered by the Hotel as part of your holiday or stay.
Whilst the claim is brought against the tour operator it is still necessary to establish that there was negligence on the part of the Hotel or their employees. As a consequence you should ensure that the accident circumstances are fully recorded and that you obtain a copy of any documentation that is produced. You should also take photographs where possible and obtain details of any witnesses. You will also need to retain all travel documentation, receipts and paperwork, including medical letters and receipts for treatment.
In the event that you booked the Hotel accommodation independently it will be necessary to pursue a claim for compensation against the Hotel directly in the country where the accident occurred. In these circumstances any claim for personal injury compensation will be assessed in accordance with the laws applicable to that particular country.
Each country has its own time limits within which a claim for personal injury compensation must be submitted. In addition the basis upon which a valid claim can be made will also vary significantly.
