Anyone injured under the age of 18 can still pursue a personal injury compensation claim although they cannot do so in their own name. Instead an adult must pursue the action on their behalf as a litigation friend.

The litigation friend will normally be a parent or guardian and may even have been involved in the accident themselves. This is providing there is no question of the adult being responsible for the accident.

  • The normal 3 year time limit does not apply;

  • Any compensation agreed between the parties should be approved by a Judge before the claim can be concluded;
  • The compensation will normally be paid into a Trust Fund held for the benefit of the child.
