Dangerous Systems & Practices at Work Compensation Claims

The Management of Health & Safety at Work Regulations 1999 require every employer to undertake a suitable and sufficient assessment of the risks to the health and safety of their employees and other individuals undertaking work on their behalf or in connection with their business.
The duty to undertake a risk assessment and to avoid injury at work extends to all employers and to all activities. The nature of the risk assessment and the steps which will be considered necessary to prevent injury at work will vary depending upon the nature of the activity itself and the work equipment that is used.
A risk assessment must be undertaken by a qualified individual who has received suitable training and has sufficient experience to identify risks. The risk assessment must also identify what steps should be taken to reduce the risks and to avoid injury at work. This may involve the introduction of new or the modification of existing work equipment, use of personal protective equipment at work as well as additional training and information.
Should the nature or frequency of a particular task change in any way, or alternatively should an accident or near miss occur the assessment should be reviewed and if necessary amended to further reduce the risk of injury at work.
The Health & Safety Executive provide further guidance on the duties placed upon employers to undertake risk assessments and provide safe systems of work on their website.
