In many circumstances agency and home workers have exactly the same right to claim personal injury compensation as any other employee. Many agency workers will take instructions directly from the organisation providing the work and paying the agency for their services. In addition that organisation may also provide all work equipment and determine exactly how the work is to be undertaken. In such circumstances where the accident arose through an unsafe system of work, defective work equipment or a hazard within the work place, a compensation claim will be pursued against the organisation providing the work rather than the agency itself.
In other situations however the agency may have control over how the work is done and provide all the equipment whilst the work itself is undertaken for a third party. Cleaning companies may be an example of such agency work. In these circumstances a claim may be more properly brought against the agency itself unless the third party could be held to be negligent for a particular reason; if for example it was believed that the accident arose through the negligence of one of the third party employees working in the same area.
