Mesothelioma Payments (2008 Scheme)

A one-off payment can be claimed where the diagnosis of mesothelioma was made prior to 25th July 2012 and was unrelated to your employment for a third party.

In addition the payment will only be made if you are not entitled to any sum under the Pneumoconiosis etc (Workers Compensation) Act 1979 or to compensation from a Ministry of Defence Scheme.

Exposure to asbestos giving rise to mesothelioma must have occurred in the United Kingdom unrelated to your employment with a third party.

For example:

  •    Contact with asbestos from a relative – e.g. by washing their clothes
  •    Asbestos in the environment – e.g. you lived near a factory using asbestos
  •    Exposure whilst self-employed

Your exposure cannot be specified but occurred in the United Kingdom.

The claim must be submitted using the appropriate form to Barrow Industrial Injuries Disablement Benefit Centre within 12 months of diagnosis, or within 12 months from the date of death where the claim is submitted by a family member or dependent.

See here for further information on mesothelioma scheme payments.

All asbestos compensation claims are pursued on a No Win No Fee basis so you can rest assured that there is no financial risk.
