If you wish to bring an Inheritance Act claim it must be issued at court within 6 months of the grant of probate(or the grant of letters of administration) in the deceased’s estate.
It is important to take legal advice in advance of this time limit, where possible, as you may need to prepare the claim for issue at court and should engage with the other parties before this.
A claim can still be made after the 6‑month time limit under Section 4 of the Inheritance Act, but you will need to explain the reasons for the delay and obtain the court’s permission. We can help you with making such an application if required.
