Jonathan joined Sintons in June 2021 and is an Associate specialising in contentious probate.

He has dealt with a large number of contentious probate and trust disputes and also has experience of Court of Protection disputes. Jonathan has acted for a wide variety of individuals, charities and professional trustees and is therefore able to appreciate the different perspectives of those involved in this kind of dispute. He has also developed experience in bringing and defending professional negligence claims where the subject matter is private client advice.

In recent years Jonathan wanted to develop his advisory/non-contentious practice – drafting wills, trusts and powers of attorney as well as administering estates. This included spending time as a member of the private client team at Sintons when he became a full member of STEP.  Jonathan finds this experience invaluable in helping inform him how best to analyse a case and deal with the various technical issues that feature in trust and probate disputes.

Jonathan is also an associate lecturer at Northumbria University where he has lectured on the subject of wills and probate. His interests include music, reading, running and spending time at the family’s cottage in North Northumberland.

Experience:

  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975: advising personal representatives and beneficiaries in a number of different claims, including complex and multi million pound estates. Cases have been dealt with by traditional litigation and alternative dispute resolution, particularly mediation
  • Claims challenging the validity of a will: cases have included claims of incapacity and the investigation of medical evidence as well as claims of lack of knowledge and approval and undue influence
  • Advising as a panel solicitor in relation to a compensation scheme operated by a national bank. The bank’s customers had been negligently advised regarding the setting up of trusts resulting in financial losses – Jonathan was one of the solicitors appointed to advise customers and guide them through the settlement process
  • Advising trust companies on a number of issues such as the interpretation of wills and various points arising in the course of administration of estates
  • Advising charity clients on how to respond to claims including working with those responsible for the charities’ PR in deciding upon the best strategy to adopt
  • Jonathan is a full member of the Association of Contentious Trust and Probate Specialists (ACTAPS).
