Sintons recently acted on behalf of a resident of Poland who sustained serious injuries in a workplace accident which took place in the UK. At the time of the incident, the client was at work in the UK on a construction site, when a metal grate fell from a height and collided with the client, causing significant injury. The client suffered with injuries to his brain, neck and back because of the incident.

Initially, the Defendant disputed the jurisdiction of the English courts, arguing that the claim should be pursued under Polish law. Has this argument succeeded, the Claimant would have been prevented from seeking compensation under English civil law. Although the client’s contract was with a Polish employer, the injury occurred while working in the UK. We successfully established that English law and jurisdiction applied, allowing the Claimant to pursue full redress under English civil law.
