‘Montreal Convention’ case settled after airport incident

A passenger who sustained several injuries after falling while preparing to board an aeroplane back to the UK following an overseas holiday has settled her case with support from Sintons.

The woman was returning from Greece when she was injured at Heraklion International Airport. As she was walking from the terminal to the shuttle bus to take her to the aircraft, her left foot and leg went down an uncovered hole.

The claimant sustained injuries to her lower back, left hip, left knee and left ankle. The incident, in May 2018, left the woman with lasting effects and exacerbated her osteoarthritis.

She pursued a claim under Article 17 of the Montréal Convention 1999, which covers damage sustained in case of death or bodily injury when the accident takes place on board an aircraft, or in the course of embarking or disembarking.

Liability was denied and the claimant turned to the specialist personal injury team at Sintons for support. The team is nationally-renowned for its capability in the most complex of matters, and associate David Knipe led the case on behalf of the claimant.

The case was litigated with Sintons securing an amicable settlement and the claimant has spoken on her positive experience in appointing Sintons to act for her.

“David Knipe was the most helpful guy, always at the end of the phone keeping me up to date with the latest news on my injury claim,” she says.

“He was very friendly, professional and easy to talk to and took the time to explain everything step by step along the way. I wouldn’t hesitate to recommend him to anyone who needs the help of a law firm in the future.”

David Knipe, who has worked in personal injury litigation for over 20 years, adds: “Pursuing a matter under the Montreal Convention is not the kind of instruction you receive every day, but our team at Sintons has the capability and experience to handle any matter, including more complex claims with an international dimension such as this.

“We were able to intervene on our client’s behalf and successfully secure a favourable outcome, which will support her and help her to move on with her life.

“Our team takes great pride in the reputation we have for fighting hard on behalf of our clients to achieve the best possible result for them, enabling them to access bespoke rehabilitation and therapy they need in addition to financial settlements we are able to secure.

“We are very pleased to have been able to support our client in this matter and wish her the very best for the future.”
