Don’t delay in resolving your financial situation post separation or divorce

Do not delay in resolving your financial situation post separation or divorce. Take heed of the recent case of Mr and Mrs Briers (Briers v Briers [2017] EWCA Civ 15) who separated in 2002 and were divorced in 2005.

Eight years later Mrs Briers brought a financial claim against her former husband and despite the length of time, the Court have allowed the claim to proceed.

Mrs Briers did however receive a reduced amount of the assets given her delay in taking action.

A note of caution for both parties therefore!

If you are separated or divorced and still require a financial settlement from your spouse, please make an appointment to discuss the situation and potential consequences.
