Do not delay in resolving your financial situation post separation or divorce. Take heed of the recent case of Mr and Mrs Briers (Briers v Briers [2017] EWCA Civ 15) who separated in 2002 and were divorced in 2005.

Eight years later Mrs Briers brought a financial claim against her former husband and despite the length of time, the Court have allowed the claim to proceed.

Mrs Briers did however receive a reduced amount of the assets given her delay in taking action.

A note of caution for both parties therefore!
