Right to Work Audits
All employers have a duty to prevent illegal working in the UK.
Where an employer provides work to a person who does not have valid permission to work in the UK, UKVI can issue the employer with a penalty of up to £20,000 per illegal worker.
Employers can only rely on the statutory defence to a criminal charge under the Asylum and Nationality Act 2006 if they have carried out a thorough right to work check prior to the worker performing any work.
It is imperative that you record the extent of any visa permissions and any conditions attached to the visa, and diarise the date upon which any such permissions and conditions will expire.
- Reviewing your offer letters to ensure that any offer of work is conditional upon the worker having the right to work;
- Auditing your right to work check processes and making recommendations to ensure robust compliance;
- Reviewing your contracts of employment to ensure they protect you in respect of the right to work;
- Providing you with a Right to Work Policy and Procedure, which you can introduce into your organisation to demonstrate your commitment to compliance.
Our Right to Work package is available to employers at a fixed cost of £490 plus VAT
We can also perform an audit of your HR files and systems, to test your processes and check that you are complying with UKVI requirements. Our audits can be conducted on either an annual or six monthly basis, to meet your specific business needs.
