Who children should live with

There is a presumption that children should live with both parents if it is safe to do so.

From an emotional point of view it is important that children have a good relationship with both parents. This will help develop their own identity and approach to relationships when they grow up.

The next step would be to discuss a routine that will work for the family. There is no right answer when it comes to what days of the week the children will be with each parent because every family is unique.

The factors at play will include both parents working patterns, the distance between the two homes and where the school is in relation to those homes. But parents have to remember that any arrangements made, must be in the best interests of the children, not the adults.

If parents are unable to reach a decision together, then they should consider alternative ways to resolve matters because a routine is much more likely to be successful if each parent has input and feels content with it.

Should a Court be tasked with the decision, the welfare of any children is their priority.  There are various factors which will be taken into account called the ‘Welfare Checklist’. Caution is advisable when considering a Court application, not least as you are putting your trust in someone else to make decisions about your own children.  In some matters this is unavoidable and we can assist in navigating, what can often be complex proceedings.
