“I’ll See You In Court” – Understanding the Litigation Process

Sintons, The Cube, Barrack Road, Newcastle Upon Tyne, NE4 6DB

Constructing Excellence in the North East in association with Sintons Law’s Kevin Anderson (Construction & Engineering Team) will discuss what happens during a construction court case (known as litigation).

The discussion will provide an understanding of the entire litigation process, including:

  • the pre-action requirements imposed upon the parties;
  • the ongoing use of alternative methods to resolve the dispute / without prejudice offers and their effect upon the litigation;
  • which court to use;
  • commencing and serving the claim, including what goes into the various pleadings;
  • the Court’s questionnaires etc. and the hearing at which directions are given to manage the case;
  • the (relatively new) use of costs budgets;
  • the disclosure process;
  • the use of expert opinion witnesses;
  • the use of factual witness statements;
  • the preparation for trial;
  • the trial itself; and
  • how to enforce the judgment both for damages and costs.

With this introductory guide to the litigation process, you will at least be armed to understand what the process shall entail should you ever find yourself involved in a court case, be that as claimant, defendant or any other interested party. Kevin will also outline his experiences of situations that have tested the boundaries of normal court procedures.
