Third party debt orders
If you believe that your judgment debtor is owed money by a third party then you can obtain an order from the court requiring the third party to pay the money owed to the debtor directly to you (missing out the judgment debtor).
Third party debt orders are a useful way to obtain payment where a judgment debtor has a bank account in which his salary is being paid.
Whilst this is one of the least used methods of enforcement, it is also one of the most effective. We believe that the reason it is not commonly used may be because the evidence to support an application for a third party debt order can be hard to obtain.
Third party debt orders can only be used to divert money owed to a debtor if you first have a judgment against the debtor.
