Orders to obtain information
Both the High Court and the County Court have a power to order a judgment debtor to attend before the court to be questioned under oath.
The main use for this method of enforcement is if you do not know if the debtor has the means to pay the debt or would like to know what assets/liabilities the judgment debtor has and his personal circumstances. It is therefore a useful first step in the enforcement process.
This little used method of enforcement can be used against an individual and if the judgment debtor is a company, an officer of the company can be ordered to be orally examined on the company’s behalf.
